1.1 These Terms of Service (these Terms) govern the use of the website of Sight on Site Optometry Pty. Ltd. (ABN 98 693 518 615) (the Practice), the engagement of the Practice's optometry services, and the purchase of any product from the Practice.
1.2 By engaging the Practice, or by using its website, the Patient agrees to be bound by these Terms.
1.3 These Terms are to be read together with the Privacy Policy and the Shipping & Returns policy. Where the Shipping & Returns policy describes a process in greater detail, that detail applies.
1.4 Nothing in these Terms operates to exclude, restrict or modify any right or remedy conferred by the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
2.1 In these Terms, unless the context requires otherwise:
2.2 Headings are for convenience only and do not affect interpretation. A reference to a statute includes that statute as amended from time to time.
3.1 The Practice provides mobile optometry consultations, prescription Eyewear, contact lenses (forthcoming) and related products and accessories.
3.2 The Practice's optometrists are registered with the Australian Health Practitioner Regulation Agency and provide care in accordance with applicable optometric professional standards.
3.3 Mobile consultations are conducted at a Visit Address agreed in advance, being the Patient's home, workplace, school or aged care facility.
3.4 Consultations are ordinarily conducted within the Practice's clinic vehicle at the Visit Address. Where an indoor setup has been agreed in advance, the consultation is conducted in a room provided by the Patient or the facility.
4.1 The Practice accepts Booking Requests. It does not offer instant or self service booking confirmation.
4.2 A booking becomes a Confirmed Booking only when the Practice has replied to the Booking Request specifying a date, an arrival window and any relevant logistical details.
4.3 The Practice will respond to a Booking Request within one business day with a confirmed date and arrival window, and will issue a reminder on the day before the visit.
4.4 The Patient must give the Practice not less than 24 hours' notice of any cancellation or request to reschedule, so that the appointment may be offered to another patient.
4.5 Separate cancellation terms may apply to group bookings for schools, aged care facilities, retirement villages and corporate clients, and will be set out in the applicable facility agreement.
5.1 Prices displayed are the final prices payable, are expressed in Australian dollars, and are inclusive of GST. Optional lens upgrades are itemised prior to payment.
5.2 Payment in full is required before an order is placed, whether online by card or in person by EFTPOS or card through the Practice's terminal.
5.3 Where the Patient holds a valid Medicare card, the eye examination is bulk billed and no amount is payable by the Patient in respect of the examination.
5.4 Private health fund optical rebates may be claimed on the spot, subject to the Patient's level of cover.
5.5 Eye examinations arranged by an employer and conducted at a workplace are not funded by Medicare and are privately billed, with private health fund claiming available.
6.1 Prescription Eyewear is custom made to the Patient's Prescription and to the Patient's frame measurements.
6.2 Changes and cancellation. An order may be changed or cancelled until the end of the day of purchase. Thereafter, prescription Eyewear is custom made and may not be cancelled or returned for change of mind. The Patient should contact the Practice if the order is not satisfactory.
6.3 Timing. An order enters lens production within one business day. Delivery may be expected in approximately 2 to 3 weeks. Specialty, prism and very high index orders may take longer, and the Practice will notify the Patient where this applies.
6.4 Suitability. The Practice reserves the right to hold an order where the Prescription is unsuitable for the frame selected, and will contact the Patient to explain the available options. Where the Patient elects to proceed contrary to the Practice's advice, the 30 day prescription warranty does not apply to that suitability issue. The Patient's rights under the Australian Consumer Law are unaffected.
6.5 Prescriptions supplied by the Patient. Lenses are made exactly to the Prescription supplied. The Patient must check the details carefully. The Practice may contact the Patient before production where any detail appears unusual. The Practice is not responsible for errors in a prescription issued by another provider. A Prescription must be in date, having been issued within the preceding 2 years.
7.1 The complete consumer policy, including shipping, changes and aftercare, is set out in Shipping & Returns. In summary:
7.2 30 day prescription warranty. Where there is a prescription error, or the Patient is unable to adapt to new lenses within 30 days of receiving the Eyewear, the Practice will reassess and will replace the lenses where the Prescription has changed.
7.3 12 month hassle free frame warranty. Every frame is covered for 12 months from the date of supply against manufacturing faults and defects. Accidental damage is not covered, though it may be repaired where possible, or replaced at a cost.
7.4 Lens coatings. Lens coatings are covered for 12 months against defective coating, subject to reasonable care.
7.5 Condition. Returned items must be in original, new condition. The Patient should contact the Practice, which will provide return instructions and an address.
7.6 Nothing in this clause 7 excludes any right or remedy conferred by the Australian Consumer Law.
8.1 In respect of a mobile consultation, the Patient is responsible for:
8.2 The Practice reserves the right to reschedule or decline a visit where the location is unsafe, inaccessible or otherwise unsuitable for a clinical examination, or where the Practice considers that the safety of its personnel or the wellbeing of the Patient would be compromised.
9.1 The information published on the Practice's website, including the Eye Health page and any article content, is general in nature and is not a substitute for personalised professional advice.
9.2 The Patient should consult a registered optometrist or other health practitioner in relation to any specific eye health concern.
9.3 In the event of an eye emergency, including sudden vision loss, chemical splash, penetrating injury or severe pain, the Patient should present to a hospital emergency department or call 000 immediately.
10.1 To the extent permitted by law, the liability of the Practice for any claim arising out of its services or website is limited to the cost of the services or products supplied.
10.2 To the extent permitted by law, the Practice is not liable for indirect or consequential loss.
10.3 Nothing in this clause 10 limits any right or remedy available to the Patient under the Australian Consumer Law that cannot lawfully be excluded.
11.1 These Terms are governed by the laws of Queensland, Australia.
11.2 The parties submit to the exclusive jurisdiction of the courts of Queensland and the courts competent to hear appeals from them.

12.2 A complaint concerning a health service provided in Queensland may be directed to the Office of the Health Ombudsman (Qld) at oho.qld.gov.au or on 133 646. A complaint concerning the clinical conduct of a registered health practitioner may be made to AHPRA at ahpra.gov.au.
